Happy single parent with childThe Maryland family law attorneys at Milstein Siegel understand the impact that legal representation can have on the lives of both former spouses after a divorce. Setting alimony levels too low or high can leave parties in unfair and financially precarious situations. Our attorneys have several years of experience with alimony and work with clients to effectively pursue the best possible resolution. If you have questions about what role alimony may play in your divorce, secure the representation of an attorney who can help you protect your rights and your best interests.

What Is Alimony?

Alimony is a court-mandated obligation for an individual to provide financial support to their former spouse after divorce. The awarding of financial support, less commonly referred to as spousal support or spousal maintenance, is one way that the courts work to recognize that spouses are sometimes financially dependent.

There are many instances where one spouse may help launch the career or business of the other, may support a spouse through an expensive education needed to engage in a lucrative career, or may have raised a family and managed the household while the other spouse focused on supporting the family financially.

How Is Alimony Determined?

Alimony is becoming more difficult to predict in Maryland, as judges have an incredible amount of latitude and discretion in determining whether to award alimony at all, as well as determining how much financial support to award and for how long.

However, some of the primary factors that help determine alimony include the age, health, income and expenses, assets and debts, need, and employability of the parties. Other factors such as the length of the relationship and the reason for the breakup of the marriage can also play a key role in determining alimony.

How Our Maryland Family Law Attorneys Can Help

Family law attorney helping with alimony Setting appropriate financial levels in a divorce is key to ensuring that both households are financially stable. By working with a family law attorney, you can fight to maintain or increase your financial stability while still keeping the other party’s interests in mind. The attorneys at Milstein Siegel take all of your needs and goals into consideration and work to ensure you are financially secure for many years following the divorce.

The need for alimony and the ability to pay it can change over time. Alimony that may have been appropriate immediately following a divorce may no longer be. We can ask the court to modify your alimony if it was court-ordered or if there is an agreement allowing for it to be modifiable. Furthermore, if your former spouse is not meeting his or her obligations, we can ask the court to enforce payment through the contempt powers of the court.
